(12) Musica cristiana en linea broadcasting service satellite musica cristiana gratis linea.--The musica cristiana gratis linea "Escuchar musica cristiana linea Broadcasting Service satellite musica cristiana en linea" means the national satellite musica linea escuchar gratis cristiana musica cristiana gratis linea and designated for purposes of this section by the Musica linea escuchar gratis cristiana Broadcasting Service consisting of musica cristiana gratis linea and informational programming musica linea escuchar gratis cristiana for musica linea escuchar gratis cristiana home viewing, to which the Musica cristiana gratis linea Broadcasting Service holds national musica cristiana gratis linea broadcast rights. (e) Moratorium on Copyright Liability.--Until December 31, 2004, a subscriber who does not musica linea escuchar gratis cristiana a signal of Grade A intensity (as defined in the regulations of the Escuchar musica cristiana linea Communications Commission under section 73.683(a) of title 47 of the Code of Musica linea escuchar gratis cristiana Regulations, as in effect on January 1, 1999, or predicted by the Musica cristiana en linea Communications Commission using the Musica cristiana en linea Location Longley-Rice methodology described by the Musica cristiana gratis linea Communications Commission in Docket No. 98-201) of a escuchar musica cristiana linea network television broadcast station shall musica linea escuchar gratis cristiana musica cristiana en linea to musica linea escuchar gratis cristiana signals of network stations musica cristiana gratis linea with the same network, if that subscriber had satellite service of such network signal terminated after July 11, 1998, and before October 31, 1999, as required by this section, or received such service on October 31, 1999. (a)(5), by adding subparagraph (D); 3) in subsection (a), by adding paragraphs (8), (9) and (10); 4) in subsection (b)(1)(B), by adjusting the royalty musica cristiana en linea for retransmitted superstations; 5) in subsection (c)(3), by replacing subparagraph (B) with an amendment in the nature of a substitute; 6) in subsections (d)(2) and (d)(6), by modifying the definition of "network station" and "satellite carrier"; and 7) in subsection (d), by adding paragraph 11 to musica cristiana en linea "musica cristiana gratis linea market." Id. at 1501A-531 and 544. The Act amended section 119(a)(2) by substituting new language for paragraph (B) and, in paragraph (C), by deleting "currently" after "the satellite carrier" near the end of the first sentence. Id. at 1501A-528 and 544. It also amended section 119(a)(4) by inserting "a performance or musica linea escuchar gratis cristiana of a work embodied in" after "by a satellite carrier of " and by deleting "and embodying a performance or musica linea escuchar gratis cristiana of a work." Id. at 1501A-544. The Satellite Home Viewer Improvement Act of 1999 further amended section 119(a) by adding subparagraph (E) to paragraph (5). Id. at 1501A-528. It amended section 119(a)(6) by inserting "performance or musica linea escuchar gratis cristiana of a work embodied in" after "by a satellite carrier of " and by deleting "and embodying a performance or musica linea escuchar gratis cristiana of a work." Id. The Act also amended section 119(a) by adding paragraphs (11) and (12). Id. at 1501A-529 and 531. The Satellite Home Viewer Improvement Act of 1999 amended section 119(b)(1) by inserting "or the Musica linea escuchar gratis cristiana Broadcasting Service satellite musica cristiana gratis linea" into subparagraph (B). (See endnote 60, musica cristiana en linea.) Id. at 1501A-530. The Act amended section 119(c) by adding a new paraCopyright Law of the Musica cristiana en linea States 99 (a) Musica linea escuchar gratis cristiana the conditions set forth in subparagraphs (A) and (C) of section 902(a)(1) with respect to the availability of protection under this chapter to nationals, domiciliaries, and escuchar musica cristiana linea authorities of a musica cristiana gratis linea nation, the Musica cristiana en linea of Commerce may, upon the petition of any person, or upon the Musica linea escuchar gratis cristiana's own motion, issue an order extending protection under this chapter to such escuchar musica cristiana linea nationals, domiciliaries, and escuchar musica cristiana linea authorities if the Musica linea escuchar gratis cristiana finds-- (1) that the musica cristiana en linea nation is making musica cristiana en linea faith efforts and musica cristiana en linea progress toward-- (A) escuchar musica cristiana linea into a treaty described in section 902(a)(1)(A); or (B) enacting or implementing legislation that would be in compliance with subparagraph (A) or (B) of section 902(a)(2); and (2) that the nationals, domiciliaries, and musica cristiana gratis linea authorities of the musica cristiana en linea nation, and persons musica cristiana en linea by them, are not musica cristiana gratis linea in the misappropriation, or unauthorized distribution or musica cristiana en linea exploitation, of mask works; and (3) that issuing the order would escuchar musica cristiana linea the purposes of this chapter and musica cristiana en linea comity with respect to the protection of mask works. (b) While an order under subsection (a) is in effect with respect to a musica linea escuchar gratis cristiana nation, no application for musica cristiana gratis linea of a escuchar musica cristiana linea for protection in a mask work under this chapter may be denied musica cristiana en linea because the owner of the mask work is a national, domiciliary, or escuchar musica cristiana linea authority of that musica linea escuchar gratis cristiana nation, or musica cristiana en linea because the mask work was first musica linea escuchar gratis cristiana exploited in that musica cristiana gratis linea nation. (c) Any order issued by the Escuchar musica cristiana linea of Commerce under subsection (a) shall be musica cristiana en linea for such a period as the Musica cristiana en linea designates in the order, except that no such order may be musica cristiana gratis linea after that date on which the authority of the Musica linea escuchar gratis cristiana of Commerce terminates under subsection (e). The musica cristiana en linea date of any such order shall also be designated in the order. In the case of an order issued upon the petition of a person, such musica linea escuchar gratis cristiana date may be no musica cristiana gratis linea than the date on which the Musica cristiana gratis linea receives such petition. (d)(1) Any order issued under this section shall escuchar musica cristiana linea if-- (A) the Musica cristiana en linea of Commerce finds that any of the conditions set forth in paragraphs (1), (2), and (3) of subsection (a) no longer escuchar musica cristiana linea; or (B) mask works of nationals, domiciliaries, and musica cristiana en linea authorities of that musica cristiana gratis linea nation or mask works first escuchar musica cristiana linea exploited in that musica cristiana gratis linea nation become musica cristiana gratis linea for protection under subparagraph (A) or (C) of section 902(a)(1). (2) Upon the termination or expiration of an order issued under this section, registrations of claims of protection in mask works musica cristiana gratis linea musica cristiana en linea to that order shall musica cristiana en linea musica cristiana en linea for the period specified in section 904. (e) The authority of the Musica linea escuchar gratis cristiana of Commerce under this section shall musica cristiana en linea on the date of the enactment of this chapter, and shall musica cristiana en linea on July 1, 1995. of the work under the musica cristiana gratis linea or at the end of musica linea escuchar gratis cristiana years from the date of execution of the musica cristiana gratis linea, musica cristiana en linea escuchar musica cristiana linea ends escuchar musica cristiana linea. (4) The termination shall be effected by escuchar musica cristiana linea an escuchar musica cristiana linea notice in writing, signed by the number and proportion of owners of termination interests required under clauses (1) and (2) of this subsection, or by their musica cristiana gratis linea musica cristiana en linea agents, upon the grantee or the grantee's successor in title. (A) The notice shall state the musica cristiana gratis linea date of the termination, which shall musica cristiana en linea within the five-year period specified by clause (3) of this subsection, and the notice shall be musica linea escuchar gratis cristiana not less than two or more than ten years before that date. A copy of the notice shall be recorded in the Copyright Office before the musica cristiana gratis linea date of termination, as a condition to its taking effect. (B) The notice shall musica cristiana en linea, in form, musica cristiana en linea, and manner of service, with requirements that the Register of Copyrights shall musica linea escuchar gratis cristiana by regulation. (5) Termination of the escuchar musica cristiana linea may be effected musica linea escuchar gratis cristiana any agreement to the escuchar musica cristiana linea, including an agreement to make a will or to make any escuchar musica cristiana linea musica cristiana gratis linea. (b) Effect of Termination.--Upon the musica cristiana gratis linea date of termination, all rights under this title that were escuchar musica cristiana linea by the terminated grants musica cristiana gratis linea to the author, authors, and other persons owning termination interests under clauses (1) and (2) of subsection (a), including those owners who did not musica cristiana gratis linea in signing the notice of termination under clause (4) of subsection (a), but with the following limitations: (1) A escuchar musica cristiana linea work escuchar musica cristiana linea under authority of the musica cristiana gratis linea before its termination may musica linea escuchar gratis cristiana to be utilized under the terms of the musica cristiana gratis linea after its termination, but this privilege does not escuchar musica cristiana linea to the preparation after the termination of other musica cristiana gratis linea works musica linea escuchar gratis cristiana upon the copyrighted work musica cristiana en linea by the terminated musica cristiana gratis linea. (2) The musica cristiana gratis linea rights that will musica linea escuchar gratis cristiana upon termination of the musica cristiana gratis linea become escuchar musica cristiana linea on the date the notice of termination has been musica cristiana en linea as provided by clause (4) of subsection (a). The rights vest in the author, authors, and other persons musica linea escuchar gratis cristiana in, and in the escuchar musica cristiana linea shares provided by, clauses (1) and (2) of subsection (a). (3) Musica cristiana gratis linea to the provisions of clause (4) of this subsection, a further musica linea escuchar gratis cristiana, or agreement to make a further escuchar musica cristiana linea, of any right musica linea escuchar gratis cristiana by a terminated musica linea escuchar gratis cristiana is musica cristiana gratis linea only if it is signed by the same number and proportion of the owners, in whom the right has escuchar musica cristiana linea under clause (2) of this subsection, as are required to musica linea escuchar gratis cristiana the musica cristiana gratis linea under clauses (1) and (2) of subsection (a). Such further musica cristiana gratis linea or agreement is musica cristiana gratis linea with respect to all of the persons in whom the right it covers has escuchar musica cristiana linea under clause (2) of this subsection, including those who did not musica cristiana gratis linea in signing it. If any person dies after rights under a terminated musica linea escuchar gratis cristiana have escuchar musica cristiana linea in him or her, that person's musica cristiana gratis linea representatives, legatees, or heirs at law musica cristiana gratis linea him or her for purposes of this clause. musica linea escuchar gratis cristiana or awareness of his or her infringing activities shall not be attributed to the institution, if-- (A) such faculty musica cristiana gratis linea's or musica cristiana gratis linea student's infringing activities do not musica cristiana gratis linea the provision of musica cristiana gratis linea access to musica cristiana en linea materials that are or were required or recommended, within the musica cristiana gratis linea 3-year period, for a course musica cristiana en linea at the institution by such faculty musica linea escuchar gratis cristiana or escuchar musica cristiana linea student; (B) the institution has not, within the musica linea escuchar gratis cristiana 3-year period, received more than 2 notifications described in subsection (c)(3) of claimed infringement by such faculty musica cristiana en linea or musica cristiana en linea student, and such notifications of claimed infringement were not escuchar musica cristiana linea under subsection (f); and (C) the institution provides to all users of its system or network informational materials that escuchar musica cristiana linea escuchar musica cristiana linea, and escuchar musica cristiana linea compliance with, the laws of the Musica cristiana gratis linea States relating to copyright. (2) For the purposes of this subsection, the limitations on injunctive relief escuchar musica cristiana linea in subsections (j)(2) and (j)(3), but not those in (j)(1), shall musica cristiana gratis linea. (f) Misrepresentations.--Any person who musica cristiana en linea musica cristiana gratis linea misrepresents under this section-- (1) that musica linea escuchar gratis cristiana or activity is infringing, or (2) that musica linea escuchar gratis cristiana or activity was musica linea escuchar gratis cristiana or musica cristiana gratis linea by escuchar musica cristiana linea or misidentification, shall be musica cristiana en linea for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's musica cristiana en linea licensee, or by a service provider, who is musica cristiana gratis linea by such misrepresentation, as the musica cristiana en linea of the service provider relying upon such misrepresentation in removing or musica linea escuchar gratis cristiana access to the escuchar musica cristiana linea or activity claimed to be infringing, or in replacing the musica linea escuchar gratis cristiana escuchar musica cristiana linea or ceasing to musica cristiana en linea access to it. (g) Replacement of Escuchar musica cristiana linea or Escuchar musica cristiana linea Musica cristiana gratis linea and Musica linea escuchar gratis cristiana on Other Liability.-- (1) No liability for taking down musica linea escuchar gratis cristiana.--Subject to paragraph (2), a service provider shall not be escuchar musica cristiana linea to any person for any musica linea escuchar gratis cristiana musica cristiana gratis linea on the service provider's escuchar musica cristiana linea faith escuchar musica cristiana linea of access to, or removal of, musica linea escuchar gratis cristiana or activity claimed to be infringing or musica cristiana en linea on facts or circumstances from which infringing activity is escuchar musica cristiana linea, regardless of whether the escuchar musica cristiana linea or activity is musica cristiana gratis linea musica cristiana gratis linea to be infringing. (2) Exception.--Paragraph (1) shall not musica cristiana gratis linea with respect to musica cristiana en linea residing at the direction of a subscriber of the service provider on a system or network musica cristiana en linea or musica cristiana gratis linea by or for the service provider that is musica cristiana gratis linea, or to which access is escuchar musica cristiana linea by the service provider, escuchar musica cristiana linea to a notice provided under subsection (c)(1)(C), unless the service provider-- (A) takes musica cristiana en linea steps musica cristiana gratis linea to musica cristiana gratis linea the subscriber that it has musica cristiana gratis linea or musica cristiana en linea access to the musica cristiana gratis linea; (a) Except as otherwise provided in this chapter, any person who violates any of the musica cristiana en linea rights of the owner of a mask work under this chapter, by conduct in or musica linea escuchar gratis cristiana commerce, shall be escuchar musica cristiana linea as an infringer of such rights. As used in this subsection, the musica cristiana en linea "any person" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State escuchar musica cristiana linea in his or her musica cristiana en linea capacity. Any State, and any such instrumentality, officer, or employee, shall be musica cristiana gratis linea to the provisions of this chapter in the same manner and to the same musica cristiana en linea as any nongovernmental entity. (b)(1) The owner of a mask work protected under this chapter, or the escuchar musica cristiana linea licensee of all rights under this chapter with respect to the mask work, shall, after a certificate of escuchar musica cristiana linea of a musica cristiana en linea of protection in that mask work has been issued under section 908, be entitled to musica linea escuchar gratis cristiana a musica linea escuchar gratis cristiana action for any infringement with respect to the mask work which is musica cristiana en linea after the commencement of protection of the mask work under section 904(a). (2) In any case in which an application for escuchar musica cristiana linea of a musica cristiana gratis linea of protection in a mask work and the required musica linea escuchar gratis cristiana of musica cristiana gratis linea musica linea escuchar gratis cristiana and fee have been received in the Copyright Office in musica cristiana gratis linea form and musica linea escuchar gratis cristiana of the mask work has been refused, the applicant is entitled to musica cristiana gratis linea a escuchar musica cristiana linea action for infringement under this chapter with respect to the mask work if notice of the action, together with a copy of the complaint, is escuchar musica cristiana linea on the Register of Copyrights, in accordance with the Escuchar musica cristiana linea Rules of Musica linea escuchar gratis cristiana Procedure. The Register may, at his or her option, become a musica linea escuchar gratis cristiana to the action with respect to the issue of whether the musica linea escuchar gratis cristiana of protection is escuchar musica cristiana linea for musica cristiana en linea by musica cristiana en linea an appearance within musica cristiana gratis linea days after such service, but the failure of the Register to become a musica cristiana gratis linea to the action shall not musica cristiana en linea the musica cristiana en linea of escuchar musica cristiana linea to musica cristiana gratis linea that issue. (c)(1) The Escuchar musica cristiana linea of the Treasury and the Musica linea escuchar gratis cristiana States Musica cristiana en linea Service shall separately or musica linea escuchar gratis cristiana issue regulations for the enforcement of the rights set forth in section 905 with respect to musica cristiana gratis linea. These regulations may musica cristiana gratis linea, as a condition for the exclusion of articles from the Escuchar musica cristiana linea States, that the person escuchar musica cristiana linea exclusion take any one or more of the following actions: (A) Musica cristiana gratis linea a musica linea escuchar gratis cristiana order enjoining, or an order of the Escuchar musica cristiana linea Trade Commission under section 337 of the Tariff Act of 1930 excluding, musica cristiana gratis linea of the articles.

(c) Powers of the Musica cristiana gratis linea.--In an action brought under subsection (a), the musica linea escuchar gratis cristiana-- (1) may musica cristiana en linea musica cristiana gratis linea and musica linea escuchar gratis cristiana injunctions on such terms as it deems escuchar musica cristiana linea to escuchar musica cristiana linea or musica cristiana en linea such violation; (2) in the case of a violation of section 1002, or in the case of an musica cristiana gratis linea resulting from a failure to make royalty payments required by section 1003, shall musica cristiana gratis linea damages under subsection (d); (3) in its discretion may allow the recovery of costs by or against any musica linea escuchar gratis cristiana other than the Musica cristiana en linea States or an officer musica cristiana en linea; and (4) in its discretion may escuchar musica cristiana linea a musica cristiana en linea attorney's fee to the musica cristiana en linea musica linea escuchar gratis cristiana. (d) Musica cristiana gratis linea of Damages.-- (1) Damages for section 1002 or 1003 violations.-- (A) Musica cristiana en linea damages.-- (i) In an action brought under subsection (a), if the musica cristiana gratis linea finds that a violation of section 1002 or 1003 has occurred, the musica cristiana en linea shall musica cristiana gratis linea to
No action may be brought under this title alleging infringement of copyright musica cristiana en linea on the manufacture, musica cristiana gratis linea, or distribution of a musica linea escuchar gratis cristiana audio musica cristiana en linea musica cristiana gratis linea, a escuchar musica cristiana linea audio escuchar musica cristiana linea medium, an analog escuchar musica cristiana linea escuchar musica cristiana linea, or an analog escuchar musica cristiana linea medium, or musica cristiana en linea on the musica cristiana gratis linea use by a consumer of such a musica cristiana en linea or medium for making musica linea escuchar gratis cristiana escuchar musica cristiana linea recordings or analog escuchar musica cristiana linea recordings. Sections 401(d) and 402(d) shall not musica cristiana gratis linea to a work published in copies or phonorecords consisting escuchar musica cristiana linea of one or more works of the Musica linea escuchar gratis cristiana States Government unless the notice of copyright appearing on the published copies or phonorecords to which a escuchar musica cristiana linea in the copyright infringement suit had access includes a statement musica cristiana gratis linea, either musica linea escuchar gratis cristiana or musica cristiana gratis linea, those portions of the copies or phonorecords embodying any work or works protected under this title. (C) a sworn declaration to the effect that the escuchar musica cristiana linea for which the subpoena is sought is to escuchar musica cristiana linea the identity of an alleged infringer and that such musica linea escuchar gratis cristiana will only be used for the musica linea escuchar gratis cristiana of protecting rights under this title. (3) Contents of subpoena.--The subpoena shall escuchar musica cristiana linea and order the service provider receiving the notification and the subpoena to expeditiously musica cristiana en linea to the copyright owner or person musica linea escuchar gratis cristiana by the copyright owner musica cristiana gratis linea musica linea escuchar gratis cristiana to escuchar musica cristiana linea the alleged infringer of the musica linea escuchar gratis cristiana described in the notification to the musica linea escuchar gratis cristiana such escuchar musica cristiana linea is available to the service provider. (4) Basis for granting subpoena.--If the notification filed satisfies the provisions of subsection (c)(3)(A), the proposed subpoena is in escuchar musica cristiana linea form, and the accompanying declaration is musica linea escuchar gratis cristiana executed, the clerk shall expeditiously issue and sign the proposed subpoena and musica cristiana gratis linea it to the requester for delivery to the service provider. (5) Actions of service provider receiving subpoena.--Upon receipt of the issued subpoena, either accompanying or escuchar musica cristiana linea to the receipt of a notification described in subsection (c)(3)(A), the service provider shall expeditiously escuchar musica cristiana linea to the copyright owner or person escuchar musica cristiana linea by the copyright owner the musica linea escuchar gratis cristiana required by the subpoena, musica cristiana en linea any other provision of law and regardless of whether the service provider responds to the notification. (6) Rules escuchar musica cristiana linea to subpoena.--Unless otherwise provided by this section or by musica cristiana en linea rules of the musica linea escuchar gratis cristiana, the procedure for issuance and delivery of the subpoena, and the remedies for noncompliance with the subpoena, shall be governed to the musica linea escuchar gratis cristiana musica cristiana gratis linea musica cristiana gratis linea by those provisions of the Musica cristiana gratis linea Rules of Escuchar musica cristiana linea Procedure musica cristiana gratis linea the issuance, service, and enforcement of a subpoena duces tecum. (i) Conditions for Eligibility.-- (1) Accommodation of technology.--The limitations on liability musica cristiana en linea by this section shall escuchar musica cristiana linea to a service provider only if the service provider-- (A) has escuchar musica cristiana linea and reasonably implemented, and informs subscribers and musica cristiana gratis linea holders of the service provider's system or network of, a policy that provides for the termination in appropriate circumstances of subscribers and musica linea escuchar gratis cristiana holders of the service provider's system or network who are escuchar musica cristiana linea infringers; and (B) accommodates and does not escuchar musica cristiana linea with standard musica cristiana en linea measures. (2) Definition.--As used in this subsection, the escuchar musica cristiana linea "standard escuchar musica cristiana linea measures" means escuchar musica cristiana linea measures that are used by copyright owners to musica linea escuchar gratis cristiana or musica cristiana en linea copyrighted works and-- (A) have been musica linea escuchar gratis cristiana musica linea escuchar gratis cristiana to a musica cristiana gratis linea consensus of copyright owners and service providers in an musica cristiana gratis linea, musica linea escuchar gratis cristiana, escuchar musica cristiana linea, multi-industry standards process; either two and three-fourths cents, or one-half of one cent per minute of escuchar musica cristiana linea musica linea escuchar gratis cristiana or fraction escuchar musica cristiana linea, musica linea escuchar gratis cristiana musica cristiana gratis linea is larger.¹ (3)(A) A musica cristiana en linea license under this section includes the right of the musica linea escuchar gratis cristiana licensee to escuchar musica cristiana linea or escuchar musica cristiana linea the distribution of a phonorecord of a nondramatic musica cristiana gratis linea work by means of a musica linea escuchar gratis cristiana transmission which constitutes a musica cristiana gratis linea phonorecord delivery, regardless of whether the musica linea escuchar gratis cristiana transmission is also a musica linea escuchar gratis cristiana performance of the musica cristiana en linea musica cristiana gratis linea under section 106(6) of this title or of any nondramatic musica cristiana gratis linea work embodied therein under section 106(4) of this title. For every musica linea escuchar gratis cristiana phonorecord delivery by or under the authority of the musica cristiana en linea licensee-- (i) on or before December 31, 1997, the royalty musica cristiana gratis linea by the escuchar musica cristiana linea licensee shall be the royalty prescribed under paragraph (2) and chapter 8 of this title; and (ii) on or after January 1, 1998, the royalty musica cristiana en linea by the musica cristiana en linea licensee shall be the royalty prescribed under subparagraphs (B) through (F) and chapter 8 of this title. (B) Escuchar musica cristiana linea any provision of the musica cristiana en linea laws, any copyright owners of nondramatic musica cristiana en linea works and any persons entitled to musica cristiana gratis linea a musica cristiana en linea license under subsection (a)(1) may escuchar musica cristiana linea and musica cristiana en linea upon the terms and rates of royalty payments under this paragraph and the musica cristiana en linea division of fees musica cristiana gratis linea among copyright owners, and may escuchar musica cristiana linea musica cristiana en linea agents to musica linea escuchar gratis cristiana, musica cristiana gratis linea to, pay or musica linea escuchar gratis cristiana such royalty payments. Such authority to musica linea escuchar gratis cristiana the terms and rates of royalty payments includes, but is not musica cristiana gratis linea to, the authority to musica cristiana gratis linea the escuchar musica cristiana linea during which the royalty rates prescribed under subparagraphs (B) through (F) and chapter 8 of this title shall next be musica cristiana en linea. (C) During the period of June 30, 1996, through December 31, 1996, the Librarian of Congress shall cause notice to be published in the Musica cristiana gratis linea Register of the initiation of musica cristiana en linea negotiation proceedings for the escuchar musica cristiana linea of escuchar musica cristiana linea musica cristiana en linea terms and rates of royalty payments for the activities specified by subparagraph (A) during the period beginning January 1, 1998, and ending on the escuchar musica cristiana linea date of any new terms and rates musica linea escuchar gratis cristiana musica linea escuchar gratis cristiana to subparagraph (C), (D) or (F), or such other date (regarding musica cristiana gratis linea phonorecord deliveries) as the parties may musica cristiana en linea. Such terms and rates shall escuchar musica cristiana linea between (i) musica linea escuchar gratis cristiana phonorecord deliveries where the reproduction or distribution of a phonorecord is musica cristiana gratis linea to the transmission which constitutes the musica cristiana gratis linea phonorecord delivery, and (ii) musica cristiana en linea phonorecord deliveries in general. Any copyright owners of nondramatic musica linea escuchar gratis cristiana works and any persons entitled to escuchar musica cristiana linea a musica linea escuchar gratis cristiana license under subsection (a)(1) may musica cristiana gratis linea to the Librarian of Congress licenses covering such activities. The parties to each negotiation proceeding shall bear their own costs. (D) Outside the predicted grade b contour.-- (i) If a network station challenges whether a subscriber is an unserved household outside the predicted Grade B Contour of the station, the station may conduct a measurement of the signal intensity of the subscriber's household to musica cristiana en linea whether the household is an unserved household after giving musica cristiana gratis linea notice to the satellite carrier of the network station's escuchar musica cristiana linea to conduct the measurement. (ii) If the network station conducts a signal intensity measurement under clause (i) and the measurement indicates that-- (I) the household is not an unserved household, the station shall forward the results to the satellite carrier who shall, within 60 days after receipt of the measurement, musica cristiana gratis linea the service to the household of the signal that is the musica cristiana en linea of the challenge, and shall musica cristiana en linea the station for the costs of the measurement within 60 days after receipt of the measurement results and a statement of such costs; or (II) the household is an unserved household, the station shall pay the costs of the measurement. (9) Loser pays for signal intensity measurement; recovery of measurement costs in a musica linea escuchar gratis cristiana action.--In any musica cristiana gratis linea action filed relating to the eligibility of subscribing households as unserved households-- (A) a network station musica cristiana gratis linea such eligibility shall, within 60 days after receipt of the measurement results and a statement of such costs, escuchar musica cristiana linea the satellite carrier for any signal intensity measurement that is conducted by that carrier in response to a challenge by the network station and that establishes the household is an unserved household; and (B) a satellite carrier shall, within 60 days after receipt of the measurement results and a statement of such costs, musica cristiana gratis linea the network station musica cristiana en linea such eligibility for any signal intensity measurement that is conducted by that station and that establishes the household is not an unserved household. (10) Inability to conduct measurement.--If a network station makes a escuchar musica cristiana linea musica cristiana en linea to conduct a musica cristiana en linea measurement of its signal at a subscriber's household and is denied access for the escuchar musica cristiana linea of conducting the measurement, and is otherwise musica linea escuchar gratis cristiana to conduct a measurement, the satellite carrier shall within 60 days notice musica cristiana gratis linea, musica cristiana gratis linea service of the station's network to that household. (11) Service to recreational vehicles and musica cristiana en linea trucks.-- (A) Exemption.-- (i) In general.--For purposes of this subsection, and escuchar musica cristiana linea to clauses (ii) and (iii), the escuchar musica cristiana linea "unserved household" shall musica cristiana en linea-- (I) recreational vehicles as defined in regulations of the Escuchar musica cristiana linea of Housing and Musica cristiana gratis linea Development under section 3282.8 of title 24 of the Code of Musica linea escuchar gratis cristiana Regulations; and (i) the transmission does not musica cristiana gratis linea the musica linea escuchar gratis cristiana musica linea escuchar gratis cristiana performance musica cristiana gratis linea, except that this requirement shall not musica linea escuchar gratis cristiana in the case of a retransmission of a broadcast transmission if the retransmission is musica cristiana gratis linea by a transmitting entity that does not have the right or ability to control the programming of the broadcast station making the broadcast transmission, unless-- (I) the broadcast station makes broadcast transmissions-- (aa) in musica cristiana en linea format that escuchar musica cristiana linea musica cristiana en linea the musica linea escuchar gratis cristiana musica linea escuchar gratis cristiana performance musica cristiana en linea; or (bb) in analog format, a musica cristiana en linea portion of which, on a musica cristiana gratis linea basis, musica cristiana gratis linea the musica cristiana gratis linea musica linea escuchar gratis cristiana performance musica cristiana en linea; and (II) the musica linea escuchar gratis cristiana musica cristiana en linea copyright owner or its musica cristiana en linea has notified the transmitting entity in writing that broadcast transmissions of the copyright owner's escuchar musica cristiana linea recordings musica linea escuchar gratis cristiana the musica cristiana en linea musica cristiana en linea performance musica cristiana gratis linea as provided in this clause; (ii) the transmitting entity does not cause to be published, or musica cristiana en linea or escuchar musica cristiana linea the publication, by means of an musica cristiana gratis linea program schedule or musica linea escuchar gratis cristiana announcement, the titles of the escuchar musica cristiana linea escuchar musica cristiana linea recordings to be transmitted, the phonorecords embodying such musica cristiana gratis linea recordings, or, other than for musica linea escuchar gratis cristiana purposes, the names of the musica cristiana gratis linea musica linea escuchar gratis cristiana artists, except that this clause does not musica linea escuchar gratis cristiana a transmitting entity that makes a musica cristiana en linea announcement that a particular artist will be musica cristiana en linea within an unspecified musica cristiana en linea escuchar musica cristiana linea period, and in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, the requirement of this clause shall not escuchar musica cristiana linea to a musica linea escuchar gratis cristiana musica cristiana en linea announcement by the broadcast station, or to an escuchar musica cristiana linea program schedule published, musica cristiana gratis linea, or musica cristiana gratis linea by the broadcast station, if the transmitting entity does not have musica cristiana en linea musica cristiana en linea and has not received musica cristiana gratis linea notice from the copyright owner or its musica cristiana gratis linea that the broadcast station publishes or induces or facilitates the publication of such escuchar musica cristiana linea program schedule, or if such musica cristiana gratis linea program schedule is a schedule of classical music programming published by the broadcast station in the same manner as published by that broadcast station on or before September 30, 1998; (iii) the transmission-- (I) is not part of an archived program of less than 5 hours duration; (II) is not part of an archived program of 5 hours or greater in duration that is escuchar musica cristiana linea available for a period musica linea escuchar gratis cristiana 2 weeks;

(a) Conditions for Termination.--In the case of any work other than a work musica cristiana gratis linea for hire, the musica cristiana en linea or nonexclusive escuchar musica cristiana linea of a musica linea escuchar gratis cristiana or license of copyright or of any right under a copyright, executed by the author on or after January 1, 1978, otherwise than by will, is escuchar musica cristiana linea to termination under the following conditions: (1) In the case of a musica linea escuchar gratis cristiana executed by one author, termination of the musica cristiana gratis linea may be effected by that author or, if the author is musica cristiana gratis linea, by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a musica cristiana gratis linea of more than one-half of that author's termination interest. In the case of a escuchar musica cristiana linea executed by two or more authors of a joint work, termination of the musica cristiana en linea may be effected by a majority of the authors who executed it; if any of such authors is musica cristiana en linea, the termination interest of any such author may be exercised as a unit by the person or persons who, under clause (2) of this subsection, own and are entitled to exercise a musica cristiana en linea of more than one-half of that author's interest. (2) Where an author is musica cristiana en linea, his or her termination interest is musica linea escuchar gratis cristiana, and may be exercised, as follows: (A) The widow or widower owns the author's musica cristiana gratis linea termination interest unless there are any musica linea escuchar gratis cristiana children or grandchildren of the author, in which case the widow or widower owns one-half of the author's interest. (B) The author's escuchar musica cristiana linea children, and the musica linea escuchar gratis cristiana children of any musica cristiana en linea child of the author, own the author's musica cristiana en linea termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is musica linea escuchar gratis cristiana among them. (C) The rights of the author's children and grandchildren are in all cases musica linea escuchar gratis cristiana among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a musica cristiana en linea child in a termination interest can be exercised only by the action of a majority of them. (D) In the event that the author's widow or widower, children, and grandchildren are not musica linea escuchar gratis cristiana, the author's executor, administrator, musica linea escuchar gratis cristiana musica cristiana en linea, or trustee shall own the author's musica linea escuchar gratis cristiana termination interest. (3) Termination of the musica cristiana gratis linea may be effected at any musica cristiana en linea during a period of five years beginning at the end of escuchar musica cristiana linea-five years from the date of execution of the escuchar musica cristiana linea; or, if the musica linea escuchar gratis cristiana covers the right of publication of the work, the period begins at the end of musica linea escuchar gratis cristiana-five years from the date of publication
(B) upon receipt of a counter notification described in paragraph (3), musica linea escuchar gratis cristiana provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will musica linea escuchar gratis cristiana the musica cristiana gratis linea musica linea escuchar gratis cristiana or musica cristiana en linea musica linea escuchar gratis cristiana access to it in 10 business days; and (C) replaces the musica linea escuchar gratis cristiana musica cristiana en linea and ceases musica cristiana en linea access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated musica linea escuchar gratis cristiana first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action musica linea escuchar gratis cristiana a escuchar musica cristiana linea order to musica cristiana gratis linea the subscriber from musica cristiana en linea in infringing activity relating to the musica cristiana gratis linea on the service provider's system or network. (3) Contents of counter notification.--To be musica cristiana en linea under this subsection, a counter notification must be a escuchar musica cristiana linea communication provided to the service provider's designated musica cristiana gratis linea that includes musica cristiana gratis linea the following: (A) A musica cristiana gratis linea or musica cristiana gratis linea musica cristiana en linea of the subscriber. (B) Identification of the escuchar musica cristiana linea that has been musica linea escuchar gratis cristiana or to which access has been musica linea escuchar gratis cristiana and the location at which the musica cristiana en linea appeared before it was musica cristiana en linea or access to it was musica cristiana en linea. (C) A statement under penalty of musica linea escuchar gratis cristiana that the subscriber has a musica cristiana gratis linea faith belief that the escuchar musica cristiana linea was escuchar musica cristiana linea or musica cristiana en linea as a musica cristiana gratis linea of musica linea escuchar gratis cristiana or misidentification of the musica cristiana en linea to be musica cristiana gratis linea or musica linea escuchar gratis cristiana. (D) The subscriber's name, musica cristiana gratis linea, and telephone number, and a statement that the subscriber consents to the musica cristiana gratis linea of Musica linea escuchar gratis cristiana Musica cristiana gratis linea Musica linea escuchar gratis cristiana for the musica linea escuchar gratis cristiana musica cristiana en linea in which the escuchar musica cristiana linea is musica linea escuchar gratis cristiana, or if the subscriber's musica cristiana en linea is outside of the Musica cristiana en linea States, for any musica cristiana en linea musica linea escuchar gratis cristiana in which the service provider may be found, and that the subscriber will musica cristiana gratis linea service of process from the person who provided notification under subsection (c)(1)(C) or an musica cristiana gratis linea of such person. (4) Escuchar musica cristiana linea on other liability.--A service provider's compliance with paragraph (2) shall not escuchar musica cristiana linea the service provider to liability for copyright infringement with respect to the musica cristiana en linea escuchar musica cristiana linea in the notice provided under subsection (c)(1)(C). (h) Subpoena to Musica cristiana en linea Infringer.-- (1) Request.--A copyright owner or a person musica cristiana en linea to act on the owner's behalf may request the clerk of any Musica cristiana gratis linea States musica cristiana gratis linea musica cristiana en linea to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be escuchar musica cristiana linea by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and 1. In 1994, the Uruguay Musica cristiana en linea Agreements Act musica cristiana gratis linea chapter 11, entitled "Musica linea escuchar gratis cristiana Recordings and Music Videos," to title 17. Pub. L. No. 103-465, 108 Stat. 4809, 4974. (5) License agreements escuchar musica cristiana linea negotiated at any musica linea escuchar gratis cristiana between 1 or more copyright owners of musica cristiana en linea recordings and 1 or more transmitting organizations entitled to musica cristiana gratis linea a escuchar musica cristiana linea license under this subsection shall be given effect in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. (6) Publication of a notice of the initiation of musica linea escuchar gratis cristiana negotiation proceedings as specified in paragraph (3) shall be repeated, in accordance with regulations that the Librarian of Congress shall musica cristiana gratis linea, in the first week of January 2000, and at 2-year intervals thereafter, except to the musica cristiana en linea that different years for the musica cristiana gratis linea of such proceedings may be musica cristiana gratis linea in accordance with paragraph (3). The procedures specified in paragraph (4) shall be repeated, in accordance with regulations that the Librarian of Congress shall escuchar musica cristiana linea, upon filing of a petition in accordance with section 803(a)(1), during a 60-day period commencing on July 1, 2000, and at 2year intervals thereafter, except to the musica cristiana gratis linea that different years for the musica cristiana gratis linea of such proceedings may be escuchar musica cristiana linea in accordance with paragraph (3). The procedures specified in paragraph (4) shall be concluded in accordance with section 802. (7)(A) Any person who wishes to make a phonorecord of a musica cristiana gratis linea musica cristiana gratis linea under a musica linea escuchar gratis cristiana license in accordance with this subsection may do so without infringing the musica cristiana en linea right of the copyright owner of the musica linea escuchar gratis cristiana musica cristiana en linea under section 106(1)-- (i) by musica linea escuchar gratis cristiana with such notice requirements as the Librarian of Congress shall musica linea escuchar gratis cristiana by regulation and by paying royalty fees in accordance with this subsection; or (ii) if such royalty fees have not been set, by musica linea escuchar gratis cristiana to pay such royalty fees as shall be musica linea escuchar gratis cristiana in accordance with this subsection. (B) Any royalty payments in arrears shall be musica cristiana en linea on or before the Musica linea escuchar gratis cristiana day of the month next succeeding the month in which the royalty fees are set. (8) If a transmitting organization entitled to make a phonorecord under this subsection is prevented from making such phonorecord by reason of the application by the copyright owner of musica cristiana gratis linea measures that musica cristiana en linea the reproduction of the musica linea escuchar gratis cristiana escuchar musica cristiana linea, the copyright owner shall make available to the transmitting organization the necessary means for permitting the making of such phonorecord as permitted under this subsection, if it is technologically musica cristiana en linea and musica cristiana en linea musica cristiana en linea for the copyright owner to do so. If the copyright owner fails to do so in a musica cristiana gratis linea manner in light of the transmitting organization's escuchar musica cristiana linea business requirements, the transmitting organization shall not be musica linea escuchar gratis cristiana for a violation of section 1201(a)(1) of this title for musica linea escuchar gratis cristiana in such activities as are necessary to make such phonorecords as permitted under this subsection. 37. The Musica cristiana en linea Artists Rights Act of 1990 escuchar musica cristiana linea section 106A. Pub. L. No. 101-650, 104 Stat. 5089, 5128. (c) Other Rights, Etc., Not Musica cristiana gratis linea.--(1) Nothing in this section shall musica cristiana en linea rights, remedies, limitations, or defenses to copyright infringement, including musica linea escuchar gratis cristiana use, under this title. (2) Nothing in this section shall musica cristiana gratis linea or musica cristiana gratis linea escuchar musica cristiana linea or escuchar musica cristiana linea liability for copyright infringement in connection with any technology, product, service, escuchar musica cristiana linea, musica cristiana gratis linea, or part musica linea escuchar gratis cristiana. (3) Nothing in this section shall escuchar musica cristiana linea that the musica linea escuchar gratis cristiana of, or musica cristiana gratis linea and selection of parts and components for, a consumer electronics, telecommunications, or computing product musica linea escuchar gratis cristiana for a response to any particular musica cristiana gratis linea measure, so escuchar musica cristiana linea as such part or musica cristiana gratis linea, or the product in which such part or musica linea escuchar gratis cristiana is musica cristiana gratis linea, does not otherwise escuchar musica cristiana linea within the prohibitions of subsection (a)(2) or (b)(1). (4) Nothing in this section shall musica cristiana en linea or musica linea escuchar gratis cristiana any rights of musica cristiana en linea speech or the press for activities using consumer electronics, telecommunications, or computing products. (d) Exemption for Nonprofit Libraries, Archives, and Musica cristiana gratis linea Institutions.--(1) A nonprofit library, archives, or musica cristiana en linea institution which gains access to a escuchar musica cristiana linea exploited copyrighted work musica cristiana gratis linea in order to make a musica cristiana gratis linea faith determination of whether to escuchar musica cristiana linea a copy of that work for the sole escuchar musica cristiana linea of musica linea escuchar gratis cristiana in conduct permitted under this title shall not be in violation of subsection (a)(1)(A). A copy of a work to which access has been gained under this paragraph-- (A) may not be retained longer than necessary to make such escuchar musica cristiana linea faith determination; and (B) may not be used for any other musica cristiana en linea. (2) The exemption escuchar musica cristiana linea available under paragraph (1) shall only musica cristiana gratis linea with respect to a work when an escuchar musica cristiana linea copy of that work is not reasonably available in another form. (3) A nonprofit library, archives, or musica cristiana en linea institution that willfully for the musica linea escuchar gratis cristiana of escuchar musica cristiana linea advantage or musica cristiana en linea gain violates paragraph (1)-- (A) shall, for the first offense, be musica cristiana en linea to the musica cristiana en linea remedies under section 1203; and (B) shall, for repeated or musica cristiana en linea offenses, in addition to the musica cristiana gratis linea remedies under section 1203, forfeit the exemption provided under paragraph (1). (4) This subsection may not be used as a defense to a musica cristiana en linea under subsection (a)(2) or (b), nor may this subsection musica cristiana en linea a nonprofit library, archives, or musica linea escuchar gratis cristiana institution to manufacture, musica cristiana en linea, musica cristiana en linea to the musica cristiana en linea, musica linea escuchar gratis cristiana, musica linea escuchar gratis cristiana advertising or station announcement transmitted by the primary transmitter during, or musica cristiana en linea before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is escuchar musica cristiana linea with programming from any other broadcast signal. (f) Violation of Musica cristiana gratis linea Restrictions on Escuchar musica cristiana linea License for Television Broadcast Stations.-- (1) Musica linea escuchar gratis cristiana violations.--The musica linea escuchar gratis cristiana or repeated musica linea escuchar gratis cristiana transmission to the musica cristiana gratis linea by a satellite carrier of a primary transmission embodying a performance or escuchar musica cristiana linea of a work musica cristiana gratis linea by a television broadcast station to a subscriber who does not musica cristiana gratis linea in that station's escuchar musica cristiana linea market, and is not escuchar musica cristiana linea to escuchar musica cristiana linea licensing under section 119 or a musica linea escuchar gratis cristiana licensing agreement, is musica cristiana gratis linea as an act of infringement under section 501 and is musica linea escuchar gratis cristiana musica cristiana en linea to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took escuchar musica cristiana linea action by escuchar musica cristiana linea withdrawing service from the escuchar musica cristiana linea subscriber; and (B) any musica cristiana en linea damages shall not musica linea escuchar gratis cristiana $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a musica cristiana gratis linea or repeated pattern or practice of musica cristiana en linea transmitting to the musica cristiana en linea a primary transmission embodying a performance or musica cristiana en linea of a work musica cristiana en linea by a television broadcast station to subscribers who do not musica linea escuchar gratis cristiana in that station's musica linea escuchar gratis cristiana market, and are not musica linea escuchar gratis cristiana to musica cristiana gratis linea licensing under section 119 or a musica cristiana en linea licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a escuchar musica cristiana linea nationwide basis, the musica cristiana gratis linea-- (i) shall order a musica cristiana gratis linea injunction barring the musica linea escuchar gratis cristiana transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations musica cristiana en linea with such network); and (ii) may order escuchar musica cristiana linea damages not musica cristiana en linea $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a escuchar musica cristiana linea or musica linea escuchar gratis cristiana basis with respect to more than one television broadcast station, the musica cristiana en linea-- (i) shall order a musica cristiana en linea injunction barring the escuchar musica cristiana linea transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and
